Tables in drive instantly previous to the graduation of this Act by advantage of the provisions of section 26 of the final Regulation Amendment Act, 1952 Act 32 of 1952 shall be deemed to be tables authorized underneath subsection 1 of this section. 1 It shall, at criminal proceedings, be enough to prove an original official document which is in custody or underneath the management of any State official by his office, if a copy thereof or an extract from that place, certified as a true copy or extract by the top of the division concerned or by any State official authorized to it by such head, is produced in proof at such proceedings. 3 Any official who, underneath subsection 1, certifies any copy or extract as true understanding that such document or extract is false shall be responsible for an offense and liable on conviction to imprisonment for a period not exceeding two years.
The court docket shall, subject to subsection 6, grant the application referred to in subsection 2a, provided that satisfied that such proof or questioning is related to the proceedings pending earlier than the courtroom. A unique official document referred to in subsection 77betsg 1, apart from the record of judicial proceedings, may be produced at criminal proceedings only upon the order of the Attorney-Normal. To rebut the presumption that a toddler to whom a married lady has given start is the offspring of her husband, such woman or her husband or each of them could, in criminal proceedings, provide proof that they had no sexual intercourse with each other through the interval when the youngster was conceived. 1 Every time any e-book or different document is of such a public nature as to be admissible in proof upon its mere manufacturing from proper custody, any copy thereof or extract from that place shall be admissible in evidence at criminal proceedings whether it is proved to be an examined copy or extract, or if it purports to be signed and certified as a true copy or extract by the officer to whose custody the unique is entrusted.
Such officer shall furnish a such certified copy or extract to any individual applying therefor, upon payment of a quantity by the tariff of fees prescribed by or beneath any legislation or, if no such tax has been so defined, an amount by such tariff of charges because the Minister, in consultation with the Minister of Finance, may now and again decide. Comparability at criminal proceedings of disputed writing with any writing proved to be real may be made by a witness. Such reports and the evidence of any witness concerning it could also be submitted as proof of the genuineness or otherwise of the writing in dispute. The provisions of sections 33 to 38, inclusive of the Civil Proceedings Evidence Act, 1965 Act 25 of 1965, shall mutatis mutandis apply concerning criminal proceedings.
